1. Definitions

In these Terms and Conditions, the following terms have the following meanings:

• "Agreement" means these Terms and Conditions as amended from time to time.
• "Services" means the legal advisory services provided by Setia Guard, including Retirement Benefit Advisory, Pension Appeal Preparation, and Employer Scheme Consultation.
• "We / Us / Our" means Setia Guard, a legal services practice registered in Malaysia and based at No. 9, Jalan Kota Laksamana 2/3, 75200 Melaka.
• "You / User" means any person who accesses this website or engages our Services.
• "Content" means all text, documents, advice notes, and other materials produced in the course of providing Services.

2. Acceptance of Terms

By using this website or engaging our Services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or engage our Services.

3. Service Description

Setia Guard provides specialist legal services relating to pension and retirement matters in Malaysia. Our three current service types are:

• Retirement Benefit Advisory (RM 570 per consultation)
• Pension Appeal Preparation (RM 1,080 per matter)
• Employer Scheme Consultation (RM 1,330 per consultation)

Services are available to individuals resident in Malaysia or with matters governed by Malaysian law. We do not currently provide Services to clients whose matters are governed solely by the laws of other jurisdictions. Availability is subject to practitioner capacity; we will advise at the point of enquiry if a service is unavailable.

4. User Responsibilities

When engaging our Services or using this website, you agree to:

• Provide accurate, complete, and up-to-date information relevant to your matter.
• Notify us promptly if any information you have provided changes.
• Treat our practitioners and staff with respect and professionalism.
• Not use this website for any unlawful purpose or in any way that could damage, disable, or impair the site.
• Not attempt to access systems, accounts, or data that you are not authorised to access.

5. Intellectual Property

All content on this website — including text, design, images, and written advice notes produced for your matter — is owned by or licensed to Setia Guard. You are granted a limited, non-exclusive, non-transferable licence to use advice notes and written summaries produced for your matter for your own personal and non-commercial purposes.

You must not reproduce, distribute, or publish any content from this website without our prior written consent.

6. Payment Terms

Fees are payable in Malaysian Ringgit (RM) as quoted at the time of engagement. Payment is due before or at the time of consultation unless otherwise agreed in writing. We accept payment by bank transfer and cash at our office.

Cancellation and refunds: If you cancel a consultation appointment giving at least 48 hours notice, no fee is payable. Cancellations with less than 48 hours notice may incur a cancellation fee of up to RM 150. Once appeal preparation work has commenced, fees are not refundable for work already completed.

7. Service Delivery Terms

• We will provide Services with reasonable skill and care in accordance with the standards of the Malaysian Bar.
• The scope of each Service is as described on our website and confirmed at the point of engagement. Changes to scope will be agreed in writing before additional work proceeds.
• Timelines for appeal preparation depend on case complexity and document availability. We will provide an estimated timeline after reviewing your matter, but cannot warrant specific completion dates.
• We maintain confidentiality in respect of all client information under legal professional privilege.

The information on this website is provided for general guidance only and does not constitute legal advice. Engaging our Services creates a professional relationship and entitles you to formal legal advice; visiting this website alone does not.

9. Limitation of Liability

To the extent permitted by Malaysian law, our total liability to you in respect of any Services provided shall not exceed the fees paid by you for the specific matter giving rise to the claim.

We shall not be liable for any indirect, consequential, or incidental losses arising out of your use of this website or our Services, including loss of income, loss of opportunity, or loss of data.

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.

10. Indemnification

You agree to indemnify and hold harmless Setia Guard, its practitioners, and staff from any claims, losses, damages, or expenses (including reasonable legal costs) arising from your breach of these Terms or your misuse of our website or Services.

11. Termination

Either party may terminate a service engagement by giving written notice to the other. If you terminate before work is complete, fees will be payable for work carried out to the date of termination. If we terminate due to your breach of these Terms, no refund will be due for work already completed.

Provisions relating to intellectual property, liability, indemnification, and dispute resolution survive termination of the agreement.

12. Dispute Resolution

These Terms are governed by the laws of Malaysia. In the event of a dispute, we encourage both parties to attempt an informal resolution in the first instance by contacting us at [email protected].

If informal resolution is not possible, disputes shall be subject to the jurisdiction of the courts of Malaysia. For complaints about professional conduct, you may also contact the Malaysian Bar Council.

13. General Provisions

• Entire Agreement: These Terms, together with any written engagement letter, constitute the entire agreement between you and Setia Guard in respect of the subject matter.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
• Waiver: Our failure to enforce any right under these Terms does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms without our prior written consent.
• Notices: Notices to us should be sent to [email protected] or by post to our office address.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of our website or Services after such changes constitutes your acceptance of the revised Terms.
