Disputed Gratuity Calculation After Early Retirement

The Situation

A client who had taken voluntary early retirement received a gratuity payment she believed was short by a significant amount. Her former employer had calculated it against a different provision than the one she understood to apply.

What We Did

We reviewed the applicable legislation alongside her employment contract and the letter of appointment. After identifying the correct provision, we prepared a formal appeal with supporting legislative citations and submitted it within three weeks.

The Outcome

The appeal was upheld. The difference in the gratuity amount was settled within two months of submission. Timeline from first consultation to resolution: approximately ten weeks.

Employer Scheme Terms Unclear on Redundancy

The Situation

An employee facing voluntary separation after restructuring was unsure what pension benefits he would receive from his company scheme on top of statutory entitlements. The scheme booklet was difficult to read and HR had given him inconsistent answers.

What We Did

We reviewed the full scheme documentation against his years of service and the voluntary separation terms. The consultation took two sessions by telephone. We produced a written note confirming the total entitlement figure under the scheme rules.

The Outcome

The client was able to confirm the correct figures with his employer before accepting the separation package. He described the process as giving him the confidence to negotiate rather than simply accept what was offered.

EPF Entitlement Review Before Retirement Age

The Situation

A client approaching 55 wanted to understand all the withdrawal options available before reaching retirement age — she had heard different accounts from family members and colleagues and was uncertain what was actually permitted.

We conducted a retirement benefit advisory session, covering Account 1 and Account 2 provisions, the full withdrawal conditions, and the relevant timing implications. We set out all available options without recommending any single course of action.
